Adults 21+ can buy recreational cannabis at state-licensed dispensaries (marked by the official NYS dispensary verification decal). Avoid the hundreds of unlicensed 'smoke shops' or convenience stores selling weed illegally; their products are untested, unregulated, and often counterfeit. Licensed delivery services are also legal and operate citywide.
Walk into any licensed dispensary. You must present a valid government-issued photo ID (driver's license, passport, or state ID) proving you are 21 or older. You can purchase up to 3 ounces (85 grams) of cannabis flower or 24 grams of concentrated cannabis per transaction. Payment is usually cash or debit card; credit cards are rarely accepted due to federal banking restrictions.
Licensed cannabis flower costs $35 to $60 per eighth (3.5g), plus a 13% state and local sales tax. Concentrates range from $40 to $80 per gram. Pre-rolled joints cost $10 to $20. All products sold in licensed dispensaries undergo rigorous state lab testing for pesticides, heavy metals, and potency.
In New York, you are legally permitted to smoke cannabis in public anywhere that tobacco smoking is allowed. This includes sidewalks and designated smoking areas. However, smoking is strictly prohibited in all public parks, beaches, boardwalks, pools, and plazas (like Times Square), carrying a $50 fine. It is also illegal to smoke in vehicles, even if parked.
